Het artikel 759 van het Gerechtelijk Wetboek wou dat iedereen voor de rechter zijn hoed afneemt als teken van respect en beleefdheid.
België werd voor deze regel veroordeeld door een arrest van het Europees Hof voor de rechten van de mens van 2018 omwille van schending van de vrijheid van gedachte, geweten en godsdienst.
Overwegend dat deze beleefdheidshandeling in onbruik is geraakt, beëindigt het wetsontwerp deze verplichting.
